Filmhimmelen 1 AS, located at Nymansveien 105, 4014 Stavanger, Norway establishes the following terms for the use of the platform www.WhoKilledTina.com: Filmhimmelen 1 AS grants the customer access, through www.WhoKilledTina.com, to stream a series for a fee on the customer's equipment, including but not limited to a computer, smartphone, or tablet, as well as selected types of Smart TVs and gaming consoles (hereinafter referred to as the customer's device). Filmhimmelen 1 AS offers the following products: – Renting a series for 2 weeks. Renting a series provides the customer access to stream and play the rented series for 2 weeks from the start of playback. Renting the series gives the customer unlimited access to stream and play the rented series as long as the series is covered by the agreement between Filmhimmelen 1 AS and the rights holders. Rented series cannot be played in offline mode without internet access.
The use of www.WhoKilledTina.com requires that the customer possesses the necessary equipment (hardware and software). The customer can order, pay for, and play the series as described in section 3. www.WhoKilledTina.com can only be used for the customer's private use, including the customer's household. Once the customer has created a profile on www.WhoKilledTina.com, the customer can freely stream the series within the EU borders and elswhere, according to the EU Regulation on the portability of online content services. The customer's use of www.WhoKilledTina.com requires the customer to create and identify themselves through www.WhoKilledTina.com login/register profile, see section 5. The use of www.WhoKilledTina.com can occur from any internet connection in the following ways: – The series can only be played on one device at a time. – The customer can use www.WhoKilledTina.com from a maximum of one device simultaneously. – The customer can choose to use www.WhoKilledTina.com on up to five different devices, registered in www.WhoKilledTina.com systems, see section 5. When using www.WhoKilledTina.com via mobile data services, the customer should be aware that the provider of mobile data services may additionally charge for the data usage, measured in megabytes (MB), used by the series. Streaming the series depends on the bandwidth of the connection used. It is recommended that the customer's use of www.WhoKilledTina.com does not occur via a broadband line where payment is based on consumption. To achieve satisfactory quality when viewing the streamed series, it is recommended that the internet connection's download speed used by the customer is a minimum of 10 Mbit/s. It is noted that the quality of the displayed series may vary depending on the customer's other use of the internet connection and variation in the communication speed of the used internet connection. Filmhimmelen 1 AS reserves the right, in special cases, including operational or security reasons, to temporarily close access to www.WhoKilledTina.com.
On www.WhoKilledTina.com, information about prices for renting the series is available. The series can be paid for and played on www.WhoKilledTina.com (via a computer), via iPhone/iPad (iOS), Android smartphones and tablets, as well as certain types of Smart TVs and gaming consoles with internet access. A receipt for the customer's order is sent to the email address associated with the customer's www.WhoKilledTina.com profile, see section 5. Payment for the series can be made in the following ways: – Using the customer's payment card, which the customer has the option to register in advance on the customer's www.WhoKilledTina.com profile, see section 5. – Stripe (Creditcard) and Paypal.
When using www.WhoKilledTina.com, delivery of the series occurs immediately after the order is completed. Subsequently, the series is available to the customer under the agreed conditions, see section 1. Since the delivery of the series takes place immediately after the customer's order, the customer, by placing the order, consents to the immediate delivery of the series, with the effect that the customer's normal 14-day right of withdrawal is waived upon delivery. www.WhoKilledTina.com profile, registration of payment cards, and processing of personal information. The customer's use of www.WhoKilledTina.com requires the customer to create a profile on www.WhoKilledTina.com. When creating a profile, the customer chooses a username and password (login data). The customer's exchange of login data with Filmhimmelen 1 AS takes place in encrypted form via a secure connection. The customer's login is personal information and cannot be disclosed to a third party. The customer is responsible for the misuse of this information by others. The customer has access to the customer's use of the series through their www.WhoKilledTina.com profile.
When the customer registers their payment card (with associated card information), a third party approved by international security standards (PCI DSS – Payment Card Industry Data Security Standard) registers and stores the necessary payment card information for future debiting of the customer's payment card, on behalf of Filmhimmelen 1 AS. The customer consents to the registration of the customer's payment card and card information, and the customer can change or unsubscribe/remove a registered payment card at any time. For Filmhimmelen 1 AS's processing of personal data, a specific privacy policy applies.
The customer's use of www.WhoKilledTina.com requires the customer to create a profile on www.WhoKilledTina.com. When creating the profile, the customer chooses a username and password (login data). The customer's exchange of login data with Filmhimmelen 1 AS takes place in encrypted form via a secure connection. The customer's login is personal information and cannot be disclosed to a third party. The customer is responsible for the misuse of this information by others. The customer has access to the customer's rented series through their www.WhoKilledTina.com profile. It is a prerequisite for the use of www.WhoKilledTina.com that the customer registers via Facebook, Google, or email, with their payment card (with associated card information) on the customer's www.WhoKilledTina.com profile for the payment of the customer's series. After payment with the customer's payment card, a receipt will be sent to the email address associated with the customer's www.WhoKilledTina.com profile. When the customer registers a payment card (with associated card details), a third party approved by international security standards (PCI DSS – Payment Card Industry Data Security Standard) records and stores the necessary payment card information for future debiting of the customer's payment card on behalf of Filmhimmelen 1 AS. The customer consents to the registration of the customer's payment card and card details, and the customer can at any time change or unsubscribe/remove a registered payment card. Filmhimmelen 1 AS processes customer data (name, address, email address, IP address, etc.), information on the customer's consumption of Filmhimmelen 1 AS (series), and the devices used by the customer when using www.WhoKilledTina.com. If the customer creates their www.WhoKilledTina.com profile via Google/Facebook, customer-specific Google/Facebook data is also processed, with the customer's consent. The processing of this data serves the purpose of 1) correctly invoicing for the customer's consumption, 2) complying with reporting obligations to content providers and preventing unauthorized use of www.WhoKilledTina.com, 3) for internal market research and marketing, including recommending content based on the customer's overall use of www.WhoKilledTina.com.
The series rented by the customer through www.WhoKilledTina.com cannot be redistributed to third parties. The customer cannot conduct public viewing, internal redistribution in businesses, or commercial exploitation of the series "Who Killed Tina?".
The series from Filmhimmelen 1 AS is protected by copyright. In the event of the customer's violation of third-party rights, such as copying, distribution, public display, commercial use of the delivered series, or unauthorized use by anyone other than the customer's household, Filmhimmelen 1 AS is entitled to terminate the customer's access to www.WhoKilledTina.com. The customer may also face penalties and liability for damages. To verify whether the copying of copyrighted content occurs, each episode in the series ordered by the customer is marked. The marking takes the form of information that can only be read on a potential copy.
The agreement for the rented series from Filmhimmelen 1 AS is subject to Norwegian law. In the event of a dispute between the customer and Filmhimmelen 1 AS arising from this agreement, the customer can file a complaint with Filmhimmelen 1 AS. Filmhimmelen 1 AS will generally make a decision no later than three months after receiving the complaint. Filmhimmelen 1 AS's decision can be appealed to the Consumer Ombudsman, Sandakerveien 138, 0484 Oslo, Norway tel +47 23 400 600, www.forbrukerombudet.no. Any disputes can otherwise be brought before the general courts in Norway, following applicable rules.
